What is a "preliminary offer"? It's either you have a contract of purchase and sale or you don't. If you do, then you can enforce that agreement. Why? Because the mortgage is a subject/contingency for YOU to fulfill - your builder has no rights or any say to your mortgage. Your mortgage could be for 25 years and for 90% of the purchase price with a 75% interest rate (awful but just an example) and there's nothing that builder can do about it because it's YOUR mortgage. I think you are right in thinking that he got a better offer. Any builder who's ever so willing to return a deposit sounds sketchy. You can refuse because you have a contract (unless you don't...) and your terms have been fulfilled.
